SUBMISSION OF MATERIALS
Iam agreeing with the following terms concerning my submission of materials (my “Portfolio Submissions”) to Tecnotoon. I understand that, to protect your creative development process, Tecnotoon will not review materials submitted for employment evaluation unless the submitter agrees to these release terms. I represent and warrant that my Portfolio Submissions are original to you and do not violate the rights of any other party.
I acknowledge that Tecnotoon may be developing materials that are similar or identical to my Portfolio Submissions and that Tecnotoon will have no obligation of any kind to my concerning those materials if Tecnotoon has created, developed or acquired them independently without reference to my Portfolio Submissions. I further agree that Tecnotoon shall have the same rights as any member of the general public to any public domain materials contained in my Portfolio Submissions.
I agree to submit any dispute concerning this release or Tecnotoon's use of my Portfolio Submissions to binding arbitration in the City and County of Miami, Florida in accordance with the commercial arbitration rules of the American Arbitration Association.
I agree that any arbitration award favorable to me shall be limited to a monetary amount that does not exceed the fair market value, as of the date of this release, of the protected portion of the Submission Materials that are the subject of the award.
I acknowledge and agree that I shall in no event have any right to seek injunctive relief to restrict the development or distribution of any Tecnotoon production. I agree that this release is freely assignable by Tecnotoon.
